Welcome to Whispering Acres RV Park (“Whispering Acres,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our website, content, and online forms (collectively, the “Site”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1) Who May Use This Site
You must be at least 18 years old and able to form a binding contract to use the Site. You are responsible for ensuring that your use of the Site complies with all applicable laws and regulations.
2) Informational Purpose Only
The Site provides general information about our RV park, amenities, pricing, and policies. Content may change without notice and may not always be complete or current. Availability and pricing are not guaranteed until confirmed directly by us.
3) Reservations, Applications & Background Screening
Submitting a contact form or inquiry does not guarantee a reservation. Long-term stays may require an application, verification of information, and compliance with our Park Rules and payment terms. If we conduct background screening, we do so in accordance with the Fair Credit Reporting Act (FCRA). Prior to any screening, we will provide a stand-alone disclosure and obtain your written authorization. If an adverse action is taken based on a report, we will provide the required notices.
4) User Conduct
- Do not use the Site for any unlawful, harmful, fraudulent, or disruptive purpose.
- Do not attempt to access systems, data, or areas you are not authorized to access.
- Do not introduce malware, scraping, or automated data collection without our written permission.
- Do not submit content that is illegal, defamatory, harassing, or infringes intellectual property or privacy rights.
5) Intellectual Property
The Site and all content (text, images, graphics, logos, videos, and code) are owned by Whispering Acres or our licensors and are protected by copyright and other laws. You may view the Site for personal, non-commercial use. Any other use (including copying, distribution, modification, or derivative works) requires our prior written consent.
6) Third-Party Links & Tools
The Site may contain links to third-party websites or use third-party tools (e.g., analytics, maps, social media). We do not control or endorse third-party sites and are not responsible for their content, policies, or practices. Access them at your own risk.
7) SMS & Text Messaging
Whispering Acres RV Park may send operational and customer-care text messages from a toll-free sending number to residents and prospective residents who have completed the required opt-in process.
Opt-in process: Enrollment is resident-initiated. To opt in, a resident texts START or JOIN to our assigned number. Whispering Acres RV Park will reply with a confirmation message asking the resident to reply YES. Operational SMS messages begin only after that YES confirmation is received.
Types of messages: Reservation updates and confirmations, resident notices and property announcements, service and maintenance updates, support and resident communication follow-up, billing and rent reminders, emergency and property notices, and customer-care communication from Whispering Acres RV Park staff.
Standard disclosures:
- Message frequency may vary.
- Message and data rates may apply.
- Reply STOP at any time to opt out.
- Reply HELP for help.
- Consent to receive text messages is not required to rent a site.
- Carriers are not liable for delayed or undelivered messages.
- Mobile opt-in data and SMS consent are not sold, rented, shared, or transferred to third parties for their marketing or promotional purposes.

8) Privacy
Your use of the Site is also governed by our Privacy Policy, which describes our data practices, cookie usage, and your choices.
9) Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10) Limitation of Liability
To the fullest extent permitted by law, Whispering Acres and our owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Site. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars (US$100) or the amount you paid, if any, for using the Site, whichever is greater.
11) Indemnification
You agree to defend, indemnify, and hold harmless Whispering Acres and our owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site.
12) Changes to the Site or Terms
We may modify the Site or these Terms at any time. If we make material changes, we will update the “Last updated” date above. Your continued use of the Site after changes means you accept the updated Terms.
13) Governing Law & Venue
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of state and federal courts located in or nearest to Tallapoosa County, Alabama, for any dispute arising out of or relating to these Terms or the Site.
14) Severability; Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of our right to do so later.
